1. Introduction
Sabine Internet strives to provide its members with the highest quality Internet service that is available and at the same time respect the standards that have been created within the Internet community. To that end Sabine Internet believes that certain activities and conduct is inappropriate or abusive and will not be tolerated on Sabine Internet network. This list is not meant to be exhaustive, but merely illustrative of examples of conduct deemed by Sabine Internet to be inappropriate and improper and therefore prohibited on our network.
2. Lawful Purpose and Use
Sabine Internet network may only be used for lawful purposes. The transmission of material that is in violation of any federal, state or local law, or that is protected by trademark, trade
secret or other intellectual property is strictly prohibited. Customers are prohibited from using the Sabine Internet network to transmit material that is judged by Sabine Internet to be illegal, proprietary, obscene, criminal or in some fashion inconsistent with the generally accepted standards of the Internet community.
3. Bulk E-mail Prohibited
Sabine Internet has zero tolerance for the use of its network by anyone for
the distribution of unsolicited bulk commercial e-mail transmissions, also
known as SPAM. Also specifically prohibited are advertising, transmitting,
or otherwise making available any software, program, product, or service
that is designed to violate this AUP or the AUP of any other Internet
Service Provider, which includes, but is not limited to, the facilitation of
the means to send e-mail spam, initiation of pinging, flooding,
mail-bombing, denial of service attacks, and piracy of software.
4. USENet Abuse Prohibited
Sabine Internet has zero tolerance for the use of its network for the posting of messages or commercial advertisements which violate the rules, regulations, FAQ or charter of any newsgroup or mailing list. Commercial messages that are appropriate under the rules of a newsgroup or mailing list or that is solicited by the recipients, are permitted.
5. Responsibility for Content
Anyone who publishes materials and information which are accessible through Sabine Internet network is solely responsible for the content of such materials and information and is solely responsible to know and comply with all laws applicable to the publication and distribution of such materials and information. Sabine Internet does not accept responsibility for the content of the materials and information published by others which is accessible through the Sabine Internet network and does not accept responsibility for the violation of any laws resulting from such publication or distribution.
6. Acceptable Use of Other Networks
Sabine Internet is an access provider and as such exercises no control over the content of the information passing through its network. It is expected that Sabine Internet customers will
comply with whatever rules or Acceptable Use Policies that are appropriate for those networks accessed through Sabine Internet. Each Sabine Internet customer accepts the responsibility to avoid whatever material it finds offensive. If any Sabine Internet customer interferes with others' use and enjoyment of the services provided by Sabine Internet, such customer shall be deemed to be in violation of this Acceptable Use Policy.
7. Subscriber Responsible for Other Users
Each member of Sabine Internet must ensure that its users do not act in a way that violates Sabine Internet Acceptable Use Policy. Sabine Internet customers are expected to bring their users into compliance with Sabine Internet Acceptable Use Policy or risk their service being discontinued.
8. Violations or AUP
Sabine Internet is solely responsible for determining if a violation of the Acceptable Use Policy has occurred. Even though Sabine Internet does not review or censor materials and information which is accessible on Sabine Internet network or other networks which may be connected to Sabine Internet network, if Sabine Internet becomes aware that one of its customers is in violation of this Acceptable Use Policy, Sabine Internet reserves the right to suspend or terminate service without notice. In addition, Sabine Internet reserves the right to interpret this Acceptable Use Policy in its sole discretion and to amend, revise, add or delete any provision of this Acceptable Use Policy.
9. Further Important Terms and Conditions
Sabine Internet strives to provide the best possible value in the Internet business. In keeping with this goal, it is necessary to maintain certain provision related to our subscriber accounts;
A. Sabine Internet, reserves the right to terminate or refuse service to anyone, at any time, for any reason. Our AUP and its terms and conditions are subject to change at any time without notice. It is the subscriber’s sole responsibility to stay informed of the terms and conditions outlined in our "Acceptable Use Policy". By using our service and/or network services you agree to the terms and condition of use. Sabine Internet, reserves the right to terminate or refuse service to anyone, at any time, for any reason. Our AUP and its terms and conditions are subject to change at any time without notice. It is the subscriber’s sole responsibility to stay informed of the terms and conditions outlined in our "Acceptable Use Policy". By using our service and/or network services you agree to the terms and condition of use.
B. All payments to Sabine Internet are Non-refundable.
C. Checks returned by your bank not paid, will be subject to a fee of $25 plus any late fees which would have otherwise been applied to your account.
D. Credit Card transactions charged back to Sabine Internet by your bank will result in a fee of $50 plus any additional fees imposed on Sabine Internet by our credit card processor. Fraudulent use of a credit card will be immediately reported to the proper authorities.
E. Adult Orientated, Graphic, Explicit, and Controversial Content. Your connection to the Internet is private and as a result we cannot control the nature of the material that you will probably encounter at some point. The World Wide Web, USEnet, and IRC chat areas are electronic virtual communities which do not censor the content delivered and/or communicated through their forums. With the use of your account on the Internet, you will have access to and you will at some time another be exposed to "free speech" that you find offensive. "Free Speech" may include sexually explicit pictures and/or documents, pro-religious and anti-religious debate, racially offensive speech, and many other possibly graphic and/or offensive documents, pictures, etc. Sabine Internet expressly disclaims liability for any harm resulting from encountering such or similar material.
F. Hold Harmless: You are responsible for all use that occurs with your account. While using the Sabine Internet service, you agree to indemnify and hold harmless Sabine Internet its officers, employees, agents, and shareholders, for any cause of action resulting from the direct or indirect use of your account.
G. All users MUST adhere to the rules set out for their Account type. Example: a dial-up account is NOT A DEDICATED ACCOUNT!!! A dial-up account is an "interactive" account and should be used to dial up, surf the Web, use email and then disconnect when finished. Interactive means that you must be at your CPU, actively using the Internet. "Keep alive" programs are SPECIFICALLY PROHIBITED. Users that insist on tying up an Internet connection that they are not actively using, will be required to purchase a dedicated account or will be terminated.
10. Billing policies, establishment of this service is dependant upon
receipt by the Company of payment of stated charges. Subsequent payments
are due on the FIRST OF THE MONTH and PUT ON HOLD at the close of business
on the 14th of the month. Invoices and/or Statements are sent as a
courtesy and failure to receive such does not relieve you of timely
payment responsibility. Accounts placed on hold for nonpayment are subject
to a $5.00 reconnect fee.
